Our firm shall not in any event be liable for any incidental, indirect, special, punitive, or consequential damages (including lost profits) that you or others may experience as a result of or relating to this agreement or the use of this service, even if we advised you of the possibility of such damages.
Use of the Client Login
The client Login is provided as a convenient way for authorized users to access documents related to services provided to you by Garcia Garman & Shea, PC (G2S). G2S may upload your documents in G2S’s possession to your account. You may also upload documents to your Client Login account through website functionality, but you may only upload documents related to services being provided to you by G2S. The Client Login may not be used to back-up ordinary materials or other records.
Security of Password
You may not share any password or access to any area of the Website granted to you by G2S with any other person. You must keep your user password and any other information needed to log-in to the Client Login confidential and secure. G2S is not responsible for any unauthorized access to your account or profile by other Website visitors and any ramifications of such access. However, under confirmed unauthorized use circumstances, G2S may take reasonable efforts with reasonable speed, to disable, lock or otherwise address your situation. In the event that you would like to report a breach, please contact firstname.lastname@example.org with the term “Account Breach Notice” in the subject line.
Like all providers of personal financial services, tax professionals are required by law to inform clients of their policies regarding the privacy of client information. Our firm adheres to professional standards of confidentiality that are even more stringent than those required by law. The only nonpublic personal information we collect is information that you provide to us or information that we obtained with your authorization.
We do not disclose any nonpublic personal information obtained in the course of our practice except as required or permitted by law. Permitted disclosures might include providing information to our employees or, in limited situations, to unrelated third parties that need the information to assist us in serving you. If you have any issues accessing your assigned portal, please contact our firm directly.
If applicable, the owner of this portal shall pay our firm all applicable fees. Our firm may adjust fees and will advise you of any fee increase before it goes into effect.
Fees and expenses paid under our agreement are nonrefundable and will not be prorated. You may cancel one or more of the Services at any time by submitting written notice to our firm.
Our firm can terminate this agreement in the event of your material breach, including failure to pay sums when due, unless resolved within ten (10) days of notice of breach or nonpayment. Our firm has the right to immediately terminate this agreement, without notice, upon your breach of confidentiality obligations or proprietary rights. In addition, and without limiting its termination rights, our firm may suspend your access to the services in the event of a breach.
Upon termination for any reason, we will store for one year any information provided by you and included in the service. We will make this information available to you upon your written request during that one year period, provided that you are current in all payments under this agreement.
You warrant to our firm that you have full power and authority to enter into this agreement and to perform your obligations herein and that you will comply with all applicable laws, rules, and regulations including those relating to professional ethics, conduct, and advertising. You represent and warrant that the provision and use of content provided by you does not and will not violate any copyrights, trade secrets or other proprietary rights of any third party, or create any liability to any third party. You acknowledge that any breach of your representations and warranties is a material breach of this agreement.
Our firm may modify these Terms and Conditions at any time. Upon doing so, you will be notified of the change and required to agree to the new terms the next time you log in to your portal. If you do not agree to the Terms and Conditions, you will not be able to access your assigned portal.
